Minimum staffing levels that congress mandated to end nursing home abuse and medicare fraud is not being enforced like with video monitoring or by having medicare directly pay sufficient teams of certified assistants to go to these understaffed nursing homes (listed on nursing home compare at medicare.gov), and get every resident up, bathed, dressed and fed. Ohio has paid bonuses to nursing homes that got high satisfaction marks on nursing home resident surveys. Unfortunately, Gene Marmor was abused at one such, chronically under-staffed nursing home, Regency Rehabilitation Center in Niles, Illinois. He has had his medicare charged for services he has never received. This is medicare fraud and so are the expensive hospitalizations that could be avoided if there were enough staff always on duty to provide enough food, water, exercise and hygiene to all the residents. Congress mandated minimum staffing levels because without minimum staffing, neglect and abuse of residents can not be mitigated. Why aren't the Judges helping him and upholding his rights?
